Terms of Use (US‑only)

Effective Date: December 6, 2025

Entity/Operator. These Terms of Use ("Terms") are a legal agreement between you and WSTBD LLC ("WSTBD," "we," "our," or "us"), 218 W 123RD St, New York, NY 10027-5683, United States. They govern your access to and use of The Spread Reflection mobile application, website, and related services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.


1. Eligibility & Region

1.1 Age. The Service is a personal journaling and self-reflection tool that uses tarot symbolism for introspection and self-discovery. It is intended for individuals 17 years of age or older in the United States. You must verify your age through a mandatory date of birth field during account creation. By using the Service, you represent and warrant that you are at least 17 years old.

1.2 Territory. These Terms apply to use in the United States only.

2. Accounts & Security

2.1 Registration. To use certain features you may need an account. You must provide accurate information and keep it current.

2.2 Credentials. You are responsible for safeguarding your login credentials and for any activities under your account. Notify us immediately of any unauthorized use.

2.3 One Person, One Account. You may not transfer your account to another person or entity without our consent.

2.4 Subscriptions & Billing. The Service may offer optional auto-renewing Premium subscriptions that provide additional features beyond the free tier. Subscriptions are purchased and managed through Apple's in-app purchase system and are subject to Apple's terms and policies. Payment will be charged to your Apple ID account at confirmation of purchase. The subscription automatically renews unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. If a free trial or introductory offer is provided, any unused portion of the free trial period may be forfeited when you purchase a subscription, where applicable. You can manage or cancel your subscription at any time in iOS Settings → [Your Name] → Subscriptions. We do not process your payment card details and cannot issue refunds directly; refund requests are handled by Apple in accordance with Apple's refund policy.

2.5 Account Deletion. If you created an account in the app, you can request deletion of your account and associated content from within the app (Profile → tap your avatar → Delete Account) or by contacting support@the-spread.org. We may retain limited information as required by law or for security and fraud prevention, and for a limited time in backups.

3. Personal Use License

3.1 License Grant. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the App and to access the Service for your personal, non-commercial use.

3.2 Ownership. We and our licensors own all rights, title, and interest in and to the Service and its content, excluding Your Content and AI Outputs (as defined below). We reserve all rights not expressly granted.

4. Your Content; AI Outputs

4.1 Your Content. "Your Content" means content you submit, upload, store, or otherwise provide through the Service (e.g., daily reflections, journal entries, spread sessions (including questions and card selections), Personal Story chapters, weekly reflection summaries, notes, tags, profile name, date of birth, avatar, photos you choose to upload). You retain your rights in Your Content.

4.2 License to Us. Solely to operate the Service, you grant us a non-exclusive, royalty-free license to host, reproduce, process, adapt, and display Your Content solely as necessary to operate the Service. This license ends when Your Content is deleted from our systems, subject to reasonable backup/archival practices and Section 15 (Termination).

4.3 AI Outputs. When you choose to use generation features, the Service uses Yandex Cloud (YandexGPT API) to generate text outputs based on your reflections, journal entries, and spread sessions, including Personal Story chapters, tarot interpretations, insights, weekly reflection summaries, and pattern analysis ("AI Outputs"). AI Outputs are tools for self-reflection and personal insight only—they are not fortune-telling, predictions, professional advice, or guaranteed to be accurate. Subject to applicable law and third-party rights, we grant you a non-exclusive license to use, reproduce, and share AI Outputs for personal purposes. You are solely responsible for your use of AI Outputs, including ensuring they do not violate any laws or third-party rights. Do not rely on AI Outputs for decisions that could cause harm.

Accuracy & Reliability: AI Outputs are generated using automated text processing and may be inaccurate, incomplete, or reflect unexpected or subjective interpretations. We do not guarantee the accuracy of AI Outputs. If you encounter content that you believe is problematic, you can report it to us at support@the-spread.org.

4.4 No Confidential Information. Do not submit information you consider confidential or highly sensitive. We implement reasonable safeguards, but we cannot guarantee the security of content you transmit.

5. Acceptable Use

You agree not to:

  1. copy, modify, reverse engineer, decompile, or attempt to extract source code from the Service;
  2. access the Service using automated means or for competitive analysis without our written permission;
  3. upload or share unlawful, infringing, defamatory, harassing, hateful, or otherwise harmful content;
  4. interfere with or disrupt the Service, including by introducing malware or overloading systems;
  5. attempt to circumvent security, authentication, or rate limits;
  6. use the Service to provide professional, medical, legal, or financial advice;
  7. misrepresent your identity or affiliation;
  8. use the Service in violation of any applicable laws or regulations.

6. Third-Party Services & SDKs

6.1 Dependencies. The Service relies on third-party platforms and software development kits, including but not limited to: authentication (Firebase/Google), database/storage (Firebase/Google Cloud), AI processing (Yandex Cloud / YandexGPT API), crash reporting, and analytics. Their terms and privacy policies may apply in addition to ours. By using the Service, you acknowledge that your content may be processed by these third-party providers in accordance with their respective terms.

6.2 AI Processing. Certain features use automated text processing provided by Yandex Cloud (YandexGPT API) to generate text outputs based on the content you choose to submit (for example, reflections, journal entries, questions, and card selections). When you use these features (for example, by tapping a generate/continue button), you instruct us to transmit the relevant content to Yandex Cloud for processing in order to provide the requested output. Yandex Cloud processes the data as a service provider/processor in accordance with its terms and privacy policy. Learn more: Yandex Privacy Policy.

6.3 No Ad Targeting. We do not sell or share your personal information for cross-context behavioral advertising.

6.4 No Control. We are not responsible for third-party services we do not control. Your use of them is at your own risk.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated by reference. It explains what we collect, how we use it, and your rights. We do not sell or share your personal information for cross-context behavioral advertising. See the Privacy Policy for details and for how to submit privacy requests.

8. Reflection Tool; No Advice, No Fortune-Telling, No Predictions

IMPORTANT: The Service is a personal journaling and self-reflection tool only. It is NOT:

  • NOT fortune-telling — We do not predict the future or provide divination services.
  • NOT professional advice — The Service does not provide medical, psychological, psychiatric, legal, financial, or any other professional advice, diagnosis, or treatment.
  • NOT a substitute for professional help — If you are experiencing mental health concerns, crisis, or any condition requiring professional attention, seek qualified professionals immediately.

8.1 Nature of Symbolic Imagery & AI Outputs. We use archetypal and symbolic imagery, including tarot cards, as creative prompts for self-reflection and introspection—not for fortune-telling, divination, or making predictions about future events. AI-generated content (interpretations, insights, chapters, summaries) is based on your own written reflections and inputs and serves to help you notice patterns in your thoughts, feelings, and experiences. AI Outputs may be inaccurate, incomplete, or subjective—they reflect your inputs, not objective truth or future outcomes.

8.2 Your Responsibility. You are solely responsible for your own decisions and actions. Do not rely on the Service, AI Outputs, or any content generated through tarot imagery for life decisions, especially those involving health, safety, finances, or legal matters. Always exercise your own judgment and consult qualified professionals when appropriate.

9. Changes to the Service

We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice, including for maintenance, security, or legal reasons. We may introduce new features or impose limits on certain features.

10. Feedback

If you send us ideas, suggestions, or comments (“Feedback”), you grant us a perpetual, worldwide, royalty-free license to use the Feedback without restriction or obligation to you.

11. Open-Source Components

The Service may include open-source software. To the extent required, the applicable open-source licenses will govern your use of those components.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR RELIABILITY OF OUTPUTS OR CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WSTBD OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 14. Indemnification

15. Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, created risk or possible legal exposure, or if we discontinue the Service. You may stop using the Service at any time. Upon termination, your license ends and Sections 4.2, 4.3, 10, 12, 13, 14, 16–23 survive.

17. DMCA (Copyright) Policy

If you believe content available through the Service infringes your copyright, please send a DMCA notice to our agent with the following: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the infringing material and its location; (4) your contact information; (5) a statement of good-faith belief; and (6) a statement under penalty of perjury of the accuracy of your notice and your authority.

18. Apple iOS Terms (Third-Party Beneficiary)

To the extent you access the Service via an Apple device:

  1. These Terms are between you and WSTBD, not Apple.
  2. Apple has no obligation to furnish maintenance or support.
  3. The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Apple Media Services Terms and Conditions.
  4. Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar laws.
  5. WSTBD, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  6. To the maximum extent permitted by law, Apple has no warranty obligations with respect to the App, and we disclaim all such warranties.
  7. Apple is a third-party beneficiary of these Terms and may enforce them against you.
  8. You represent that you are not located in a country subject to a U.S. Government embargo or on any U.S. Government list of prohibited or restricted parties.
  9. You will comply with applicable third-party terms and with U.S. and international export laws and regulations.

19. Export & Sanctions Compliance

You may not use, export, or re-export the App or Service except as authorized by U.S. law. You represent and warrant that you are not located in, under the control of, or a national or resident of any embargoed country or on any U.S. Government list of restricted parties.

20. Governing Law; Venue

These Terms are governed by the laws of the State of New York, excluding its conflict-of-law rules. The state and federal courts located in New York County, New York have exclusive jurisdiction and venue over any dispute arising out of or relating to the Service or these Terms, and you consent to such jurisdiction and venue.

21. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be effective when posted with a new Effective Date. If a change is material, we will provide additional notice where required by law. Your continued use of the Service after the Effective Date constitutes acceptance of the updated Terms.

22. Miscellaneous

22.1 Entire Agreement. These Terms, together with the Privacy Policy and any additional policies referenced herein, are the entire agreement between you and us regarding the Service.

22.2 Severability. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.

22.3 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

22.4 Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

22.5 Headings. Headings are for convenience only and do not affect interpretation.

22.6 Force Majeure. We are not liable for delays or failures due to causes beyond our reasonable control (e.g., acts of God, labor disputes, internet failures, governmental actions).

22.7 No Third-Party Beneficiaries. Except as expressly stated in Section 18 (Apple iOS Terms), these Terms do not confer any third-party beneficiary rights.

Current Business Model Disclosure (Informational)

The Service currently includes an optional auto-renewing Premium subscription purchased through Apple's in-app purchase system. Core journaling and reflection features remain available without a paid subscription, while Premium unlocks additional or extended features. If our business model changes in a material way (for example, if we add other types of paid offerings), we will update these Terms and the App listing accordingly.
